En el presente artículo de revisión, se abordará el reconocimiento de las libertades de religión, de culto y de conciencia, como resultado de incesantes luchas entre quienes monopolísticamente manejaban los hilos del poder espiritual –incluso el temporal– y aquellos que, orientados por conceptos distintos, pregonaban las ideas liberales desarrolladas vehementemente a partir de la Revolución Francesa de 1789. De igual forma, se analizará el proceso jurídico-constitucional que llevó a Colombia a poseer una Carta Magna donde se protegen las libertades y se reconoce la diversidad, como derecho inalienable del ser humano, sumado a la imperativa aplicación del principio de igualdad sobre todas las relaciones que con ocasión al ejercicio de los derechos y garantías fundamentales, surjan entre el Estado y los particulares, y entre estos.AbstractIn the present article of review, there will be approached the recognition of the freedoms of religion, of worship and of conscience, as result of incessant fights between whom monopolisticamente were handling the threads of the spiritual power –enclosedly the temporary one– and those that, orientated by different concepts, were proclaiming liberal developed ideas vehement in way since the French Revolution of 1789. Also there was analyzed the juridical-constitutional process that led Colombia to possessing a Constitucion where the freedoms are protected and the diversity is recognized, as inalienable right of the human being, added to the imperative application of the beginning of equality on all the relations that with occasion to the exercise of the rights and fundamental guarantees, should arise between the State and individuals and between these.

Este escrito es producto de una ponencia realizada en el marco del sub-proyecto Violencia Intrafamiliar que alimenta el macroproyecto Tipologías de la Violencia, desarrollado por el Centro de Investigación de Ciencias Sociales Humanas y Jurídicas CISHJUR de la Universidad Simón Bolívar en convenio con el Centro de Investigación y Análisis Convivencia Justicia y Seguridad Ciudadana del Atlántico, de cuyos frutos resulta que la violencia intrafamiliar es la conducta que produce daño físico, psicológico, a los miembros de la familia, llámese padres, madres, abuelos, hijos, sobrinos, cónyuge, compañero o compañera permanente, hermano que se encuentren bajo la dependencia y cuidado del grupo familiar. Es un síntoma del caos social en que la humanidad ha venido evolucionando, donde la falta de empleo y oportunidades, la cultura y la no aplicación de las garantías normativas que el Estado ha dispuesto para su protección, han dado pie a que esta problemática se agudice más y más. AbstractThis article is a result of a presentation that took place in the sub-project “Domestic Violence” that makes part of the macro-project “Typologies of Violence”. The macro-project is developed by the Simon Bolivar University’s Research Center for Humanities and Legal Social Sciences together with the Research and Analysis Center for Coexistence, Justice and Public Safety of the Atlantic Department. A conclusion of this project remarks that the domestic violence is a behavior that causes physical and psychological damage to the family members, like parents, grandparents, kids, nephews and nieces, siblings and other people depending of the familiar group. Domestic violence is a sign that the humanity has been evolving in the middle of a social chaos. It is a chaos where the lack of employment and opportunities, the culture and the no implementation of laws that the state has stipulated to warranty the protection, has made this problem get worse.
