Considering the social integrative function that the right exercises, the same can not be accomplished merely by the inherent understanding of the world of life, either by functional systems regulators, particularly the economic and political system specialized in strategic rationality. Habermas sees the figure of the modern positive law, the possibility of assimilating – via communicative action – the tension between facticity and validity. In view of this possibility, the philosopher seeking to engage with the central problem that embraces the possibilities of social reproduction in the light of validity claims. Integrating social phenomenon that articulate the tension between the factual and the counterfactual, directs us to implement the concept of the life world. The use of the term “colonization” is due to the fact that the open questions before a proposed solution communicative being waged in the world of life are conveyed to a legal argument that, in addition to “stifle” genuine solutions such production by the affected reflects the structure of law that the world itself is not life, but the systems of Economy and State.
