Contrary to the legal-discursive way of conceiving power from the negativity of the law, Michel Foucault proposes an analytic of power as essentially conceived as capable of producing and enhancing life. The article deals with the interpretation that on this type of iopower presents Michel Foucault both in History of Sexuality I, as in “Society must be defended”. The regulation of the sale of motor vehicles in Cuba, as well as other forms of inter vivos transfer of property over those goods, has meant a substantial challenge for judicial officers and society in general. Officers must interpret the principles recognized in that law according to the political and economic foundations enshrined in the Constitution. Although Decree 292/2011 generates multiple questions, in essence gives legal protection to legal acts with deep roots in society, responds to the historical moment of its enactment and directs the new directions of the country’s economic policy. So the best thing is that the judicial officers interpret it with rationality and logic, in tune with the political sources that prompted it and forming part of the legal system in which it is incorporated. - Key issues of fiscal federalism and regional asymmetries in the Republic of Argentina

This paper presents a critical-propositive and structural approach (constitution, revenue sharing law, fiscal pacts and certain conditional transfers) of the Argentine fiscal distribution system (fiscal federalism) in relation to the effective delivery of basic public services (essential) for a decent life for people throughout the country, with important elements of analysis such as the generation of appropriate endogenous regional capacities, infrastructure and quality -quantity of the service offering in relation to demand or population needs-. It is a qualitative study, not experimental, which analytical instruments are current data published by the National Institute of Statistics and Census (INDEC) concerning the provision, quantity and quality of public services in different regions of the country, last national census of 2010, current and historical legislation on Argentine fiscal federalism and the specialized doctrine in this issue. - New challenges for environmental law from the biolaw perspective: Special reference to animal rights and future generations

Positive Criminology was influential during the first half of S XX in Latin America. This discourse coined in Italy configured an etiological conception of crime and the offender. Colombia has unique characteristics compared to the rest of Latin America: its political, social and historical context, prevented that these concepts were incorporated in the same way as the rest of these countries. During the 30’s authors close to socialism, as Luis Carlos Pérez and Jorge Eliécer Gaitán, retook criminal sociology to explain some phenomena of crime and social control. Most of Pérez’s work are outstanding contributions to Colombian criminal law, ignoring one of his first works: “Criminology. The new naturalistic crime”. This article aims to reflect on the right to peace in Colombia from the critical perspective of human rights, through documentary analysis of The Oslo Declaration on the right to peace, the Constitution of Colombia, and the Sentence C-370/06 of the Constitutional Court. To this purpose four dimensions of human rights are presented: ethical, political, social and legal, in order to analyze the situation of the human right to peace, understood as a mandatory right and a State duty. The paper argues that talking about the right to peace implies noting that the axis of the State is the human dignity, and not the market and its demands; also argues that, if we want peace and establish it as a human right, it is necessary to rethink the State’s relationship with the market, recognizing human dignity as an integrating axis of human rights and the Estate. - Theoretical approach of the bankruptcy revocation action in the argentine law from a study of their rules and doctrine, in the framework of bankruptcy law

This article discusses theoretically substantive and procedural aspects of the Bankruptcy revocation action under Argentine law, based on Law No. 24,522, the doctrine specialized in Argentine bankruptcy law and some judicial pronouncements. It was made a review of the structure of the action based on a reflection that would clarify its importance for the operation of trade relations. The above action is seen as an appropriate measure to safeguard the general pledge of creditors in the development of legal negotiable relations, allowing economic balance between the parties and respect for the principle of pars conditiocreditorum. - We would not exist without the Court: discourses about non-heterosexual house holds in Colombia

This article, based on concepts and methodological tools characteristic of socio-legal and cultural studies, analyzes the main discourses that appear in the representations of non-heterosexual households, specially same-sex couples, given by the media in Colombia, specifically in national newspapers in the period between 2007 and 2010. Recognizing the undeniable prominence of legal discourse at the time of understand the whole landscape of visibility and the existence of same-sex couples, there is a clear need to relate it to other discourses from various sources, such as medical, cultural and social. After making a journey through selected press notes related to such unions, and identifying the discourses around visibility and existence from them emerging, it is concluded, among other aspects, that despite significant jurisprudential protection that same sex couples have obtained in the country, prejudice, stereotyping and hate speech against them keep circulating regularly, being enormous obstacles to the existence of such non-heterosexual relationships.
