  • 1991 Colombian Constitution, Quota Act, and feminist movement: the role of law in the emergence of mobilizing structures

    This paper highlights how little conceptualization there is on the relationship between the use of legal mobilization and social movements’ mobilizing structures. To contribute to such theorization, it proposes a hypothesis of the impact of the 1991 Colombian Constitution on the feminist movement. Through the case study of the campaign around the Quota Act, it argues that the most important impact was the generation of meeting arenas for the emergence of new mobilizing structures.

    This article presents the life and work of Nina S. de Friedemann. It highlights the relevance of her studies on Black and Indigenous cultures in Colombia, and demonstrates her understanding of terms such as identity, ethnicity, and traces of African presence. Taking as a point of departure the Nina S. de Friedemann Collection, unpublished texts from the journal América Negra, and discussions with family members and colleagues, this proposal entails creating a dialogue between her research processes and several transformations over that last two decades that affected the communities for which she worked. Finally, the memoirs of the event “Conversations: 20 years without Nina” are presented in order to highlight the intellectual focus and historical commitment of women and men in order to consolidate a horizon of study of the Afro-Latin American cultural tradition.

    The paper analyzes the organizational learning process experienced in the design of a new packing servicefor the pharmaceutical sector, using the 4I model designed by Crossan, Lane and White (1999) and itsfurther developments. It was carried out an exploratory study using qualitative research methods. It wasfound evidence supporting the learning processes stated by the original model and its furtherdevelopments. The interviews and focus group results suggested that organizational learning is not alwaysa lineal process as stated by the model. Individual and group learning are parallel interacting and unfinishedprocesses. This study contributed to adding empirical evidence to the 4I model of organizational learningand its further developments, in a manufacturing firm.

    Si se me pidiera por adelantado enunciar los objetivos de este ensayo, diría que el primero es mostrar la forma como el filósofo norteamericano John Rawls y el alemán Jürgen Habermas hacen un uso de una razón construccionista y de una razón dialógica, respectivamente, para darle a la justicia una preeminencia moralque hace tiempo no tenía en la filosofía práctica. Pero ese es un objetivo más interesante para los historiadores de la filosofía que para los juristas, políticos, pensadores sociales y estudiantes de humanidades para quienes escribo este ensayo. A ellos mi segundo objetivo les puede interesar más: mostrar a la justicia como el concepto rector para establecer la moralidad de lo político y de lo jurídico. Para lograr ambos objetivos, poniendo más énfasis en el segundo, seguiré el siguiente orden. Comenzaré (I) mostrando lo que significó reivindicar el concepto moraljusticia en el siglo XX, un siglo difícil para la filosofía práctica de vocación normativa. Hecho esto, procederé a (II) mostrar el modo en que ambos pensadores intentan restaurar la moralidad como criterio de legitimidad de las instituciones públicas e intentaré (III) mostrar cómo ese criterio conecta lo constitucional y lo político.

    Organizations need well trained employees in order to maintain a competitive advantage. The purpose of this paper is to describe current training practices in Peru and to provide recommendations for improving organizational performance. This paper also aims to set priorities for future research work. Human capital theory and contributions on need assessment, and training planning, implementation and evaluation served as theoretical framework. This is a cross-sectional, exploratory study that used information from surveys conducted in 24 Peruvian companies. The findings reveal a strong interest in training, particularly with regard to the improvement of competencies, preference for face-to-face training, and the use of reaction evaluation methods. The recommendations include, among others, improving the provisions for internal support, policies, technology, behavioral evaluation, and resources.

    The paper focuses on the analysis of the narrative of various abolitionist acts and the impact they had on the problematization of slavery. The author argues that, from the  very beginning, the analysis of abolitionist acts manifests a contradiction with the independence discourse with regards to the idea of maintaining a part of the population as slaves. Yet, in practice, the acts aimed less at the brining into being of citizens and more in providing guarantees to slave-owners of compensation as well as preventing, by means of individualized surveillance and other instruments of control like concertaje, that the liberated participate in the distribution of the wealth and prestige and they are kept on the margins of society.

    Given the lack of systematic reviews in Mexico that explore the phenomena of Cyberbullying and Grooming, types of digital violence that mainly affect children and adolescents, this research was conducted with the aim of identifying the approach that has been given to the phenomenon within the country between 2000-2022. The PRISMA method was used and publications indexed in the Open Access databases SciELO, Redalyc, Dialnet, ScienceDirect and PubMed were consulted.  Thirty-five studies were analyzed between 2000-2022, finding a high prevalence of quantitative works that mainly explore the nature and dynamics of Cyberbullying; most of the studies are concentrated in the center-north of the country, with more than two authors per article. The almost null research on Grooming in Mexico stands out, as well as studies on validation of instruments and intervention programs against Cyberbullying; in future reviews it is suggested to explore non-indexed sources that broaden the scope that has been had of the phenomenon.

    The paper analyzes the military rule of Gustavo Rojas Pinilla as an attempt to establishment a populist government. Using the approach proposed by Ernesto Laclau, this paper examines a historical and philosophical mobilization of the Colombian popular national symbols like the Sacred Heart of Jesus, Liberator Bolívar, and National Unity that were monitored by the General Rojas Pinilla. The author pays a particular attention to those elements in the discourse of the General that articulate historically unmet demands of the Colombian people with their new leader, but luck the real meaning. The paper concludes with an assessment of reasons why the populist mobilization, which intended to use symbols, failed in Colombia.

  • Absence and Presence of the State as a Reproduction Way of Urban Violence in the Aguablanca District (Cali, Colombia)

    Based on an ethnographic approach, this article describes how the notions of presence and absence of the state are manifested, simultaneously, in the Aguablanca District (Cali, Colombia). Within a context of urban violence, this is an obstacle when recognizing the effects of the state’s actions and omissions. Additionally, it can be noticed how the readings on violence intending to generate alternatives to mitigate this scourge enable the confrontation of imaginaries between communities from marginalized areas, elite areas, and the state. Thus, we see the emergence of signaling practices and discourses that assign violent identities to black communities and the Aguablanca District, which serve to present them as accountable for Cali being one of the most violent cities in the world, and it favors the execution of racial and territorial segregation practices, and “state” and “parastatal” actions that reproduce violence.

    El gobierno colombiano ha financiado durante los últimos cinco años el déficit fiscal en gran medida con recursos provenientes del ahorro nacional, a través de emisiones de títulos en condiciones de rentabilidad innecesariamente altas, frenando la tendencia de disminución de tasas de interés internas. Adicionalmente, la estructura institucional gubernamental a través de la cual se realiza la colocación primaria y la negociaciónsecundaria de dichos títulos, genera una competencia desigual que desplaza a los demás agentes económicos, especialmente el sector productivo, como captadores de recursos del mercado de capitales para financiar sus negocios. Lo anterior ha ocurrido en un período caracterizado por crisis del sector financiero y recesióneconómica.

    The aim of this article is to present the trajectory of the social mobilization led by young artists during the “Paro Nacional” in Roldanillo, Valle del Cauca. For this, sociological concepts such as “collective action” and “collective identity” are considered. In addition, special emphasis is placed on art as a vital element for the renewal of the political and thus social protest in the country.

    El artículo estudia el debate sobre el control constitucional de las providencias jurídicas y su desarrollo. Presenta los argumentos de los críticos, ofrece contra-argumentos y describe lo que se requiere para que el control constitucional proceda contras las decisiones judiciales. Para eso, formula el problema fundamental del debate: ¿debería existir un mecanismo que proteja a las personas de las sentencias que violen sus derechos constitucionales? El artículo muestra que el control constitucional defiende los derechos en un sentido material, y cómo una interpretación única y autorizada de la Constitución promueve la seguridad jurídica.

    Un año después de su promulgación, entró a regir el 6 de agosto del año en curso la Ley 472 de 1998 sobre protección de los derechos colectivos, dando paso, así sea con injustificado retardo, a la consolidación de lo que la doctrina jurídica en Colombia denomina "trípode del garantismo constitucional", sobre el cual, dada su importancia, vigencia y actualidad (puesto que no es tema exclusivo de juristas), bien vale la pena hacer algunas breves reflexiones desde el punto de vista del binomio inescindible "comunidad-empresa". Como que una primera "pata" la conforma la acción de tutela (Art. 86 de la C.P. y Decretos 2591 y 306 de 1991); una segunda, la acción de cumplimiento (Art. 87 de la C.P. y Ley 393 de 1997); y una tercera, las acciones *Class action, en el sistema jurídico anglosajón populares y de grupo (Art. 88 de la C.P. y Ley 472 de 1998, objeto de este comentario).

    In this panel, a group of Black scholars gathers to discuss political, intellectual, and practical meanings of activist research in the Americas. Talking across the Atlantic, the authors generate responses to questions related to the following topics: knowledge and epistemological orientations, theory, positionality and power, and the alternatives in which socially-engaged research and change are offered. Calling on ruminations from research and personal experience, this article considers how Blackness augments the processes by which scholar activism has been created and understood by the authors. These comments seek to highlight not only the precarity in which such work is defined, but the opportunities that stand to be gained in understanding racial, sexual, and gendered elements of historical and contemporary social life through interdisciplinary and transnational perspectives.
