Este artículo pretende mostrar los avances en la constitucionalización del procedimiento contencioso administrativo, con ocasión de la reforma a la Ley 1437 de 2011, que se materializó con la Ley 2080 de enero del 2021, en plena pandemia del covid-19, reforma mediante la cual se avanzó en la concreción de los principios constitucionales de transparencia, seguridad jurídica, buena fe, respeto del debido proceso, acceso efectivo a la justicia material, inmediación y oralidad, los cuales permiten concretar el Estado Social de derecho. - Constitutional control, policies of state and policies of government, programs of renovation of the public administration

This academic article tries to analyze the form how the Law 790 of 2002 by which the program of renovation of the public administration with the restriction of the "social detent" settled down, in his article 12 it generated a discrimination for the parents head of household, to those who it was not sheltered to them with the propose exceptions, leaving without sustenance to the children of these families and the arguments that the Constitutional Court used to declare conditionally exequible east article and to preserve the rights of these children through the labor stability of its parents. - The processes of transitional justice, justice, truth and reconciliation in the francophone and Latin America context

The purpose of this dissertation is presenting the advances in Colombia regarding the objective responsibility of the State for some events of the justice administration and the possibility of repeating against its Magistrates and judges for juridical mistakes or for absolutory or inhibitory fail. In the same line, the jurisprudential, doctrinal and legislative advances will be highlighted, of the same theme in Spain. Both geographical contexts are studied to the light of the principles of the Iberoamerican Code of Jurisdictional Ethics, specifically in what is related with the principles of Independence and autonomy of the judges, as a corollary of a Democratic State of Law.
