El proceso de reflexión permite establecer la pregunta ¿cuáles son los componentes éticos que pueden guiar y complementar la función del docente en derecho? La enseñanza del derecho consiste en impartir conceptos teóricos de la dogmática, sus escuelas y su evolución, sin embargo, el proceso queda incompleto porque no existe un vínculo entre el derecho, la ética y la política conforme a lo planteado por Kennedy (2007) y un enfoque de las capacidades conforme a los presupuestos de Sen (1996). El presente artículo tiene como objetivo describir aspectos de justicia social en la enseñanza del derecho y el enfoque de las capacidades, además busca hacer una reflexión de la labor del docente de derecho y su ética. Se proponen algunas líneas de pensamiento filosófico y bioético mediante la investigación documental interpretativa; el proceso reflexivo se establece por medio de la información obtenida y analizada en textos y artículos de revistas indexadas a partir del análisis crítico del discurso. Destaca como conclusión principal la importancia de constituir unos criterios que permitan complementar la labor de la enseñanza tradicional del derecho como la ética de la justicia social para los menos favorecidos, la ayuda humanitaria, el vínculo emocional docente-estudiante y los nuevos derechos.

Reconciliation has been a challenge for the Colombian post-conflict, the difficulty of building a national identity is reflected in the political polarization that exists. History makes it possible to establish victims and perpetrators, however, defining the path to reconciliation involves a challenge; the force to forgive and forget must be immersed and the perpetrators must admit their actions. What factors prevent the development of a framework of justice in the process of remembrance, forgetfulness and recognition of past criminal actions and that continue to occur that do not allow the implementation of the peace agreement between the National Government and the FARC EP? The objective is to determine the social, public order and economic problems of peasants and those reinserted as victims from a Justice approach in the post - conflict framework. Some lines of thought are proposed through interpretative documentary research and the reflective process is reflected in the documents analyzed. As a main conclusion, it is proposed that a national reconciliation process that involves the detractors of the peace agreement is necessary to identify the factors that prevent peace in the fields of Colombia

Once the Political Constitution of 1991 was enacted, Colombia has given special protection to the environment, creating a series of mechanisms that can guarantee its integrity. However, despite the existence of regulations and public policies on this matter, it is evident the prioritization of a substantial content and weaknesses in its application, as in the case of the Suesca Lagoon, which has been presenting a progressive depletion in its water body, reaching a critical point in the year 2020, when it reduced its volume in a high percentage. From there arises the objective of the research, being to analyze the public policies aimed at the protection of the Suesca lagoon and its application in the municipality of Suesca Cundinamarca. To approach, this research a qualitative approach was used, and the legal-systematic research method was employed, which allows a comprehensive understanding of the phenomena under study in an integral way, together with the application of semi-structured interviews, whose analysis, focused on the measures adopted from the perspective of public policies aimed at the protection of the Suesca lagoon. These strategies showed that on the one hand, prevention has not been prioritized in terms of this water resource, giving way to mostly mitigation measures. On the other hand, the participation spaces that include the affected or interested population in the construction of such public policies are still incipient and demand greater attention and prioritization.
